Response to Transgender Inquiries

Today, the U.S. Department of Education Office for Civil Rights (“OCR”) and the U.S. Department of Justice Civil Rights Division issued guidance regarding the protection of transgender students in schools under Title IX. Although the OCR guidelines are not law, OCR does have the enforcement mechanism to sanction school districts and endanger federal funding for failing to follow OCR’s interpretation of federal law. Celina ISD previously has and will continue to comply with Title IX. Celina ISD is focused on partnering with parents and the community to provide a safe learning environment for all students. Currently, Celina ISD does not have a specific policy governing transgender students, however, the District is committed to following state and federal law as well as policies adopted by the Board of Trustees. The District is aware that both state and federal guidance has been issued regarding transgender students this past week and will review the guidance and make any changes necessary to comply with the law. Any policies adopted by the Board regarding these issues will be addressed in a transparent and open manner, in accordance with Board policies and procedures.  However, most issues regarding specific transgender students are confidential under federal law, and the District is acting in compliance with the laws and policies that govern transgender students, as the District would with any other student in maintaining the privacy of student identifiable information.  The District is diligently working to keep apprised of this evolving area of law and intends to make its best efforts to continue compliance with state and federal laws and applicable Board policies regarding this matter.
